用户协议（最终用户许可协议）
本用户协议（以下简称「本协议」）是你与本应用开发者 BoZhi Yuan（以下简称「我们」）之间就使用「诗境」（Poetic Mist，以下简称「本应用」）所达成的具有法律约束力的协议。下载、安装或使用本应用，即表示你已阅读、理解并同意受本协议约束。如你不同意，请勿使用本应用。
一、许可授予
我们授予你一项个人的、非独占的、不可转让、不可再许可、可撤销的有限许可，允许你在你拥有或控制的、且符合 Apple 使用条款的 Apple 设备上，下载并使用本应用，仅用于个人非商业目的。本应用按「现状」授权使用，你并未获得本应用的所有权。
二、订阅与计费
本应用通过 Apple App Store 内购（IAP）提供自动续期订阅，以解锁完整功能：
- 月度订阅：每月 $2.99（美元，或按 Apple 汇率换算的当地货币等值价格）。
- 年度订阅：每年 $29.99（美元，或当地货币等值价格）。
- 免费试用：符合条件的新订阅用户可享 3 天免费试用。若你在试用期结束前未取消，试用将自动转为付费订阅。
订阅相关条款：
- 自动续期：除非你在当前周期结束前至少 24 小时关闭自动续期，否则订阅将自动续期。
- 续期扣费：续期费用将在当前周期结束前 24 小时内由你的 Apple ID 账户扣取。
- 管理与取消：你可随时在设备的「设置 → Apple ID → 订阅」中管理或取消订阅。取消将在当前已付费周期结束时生效；当前周期内不予按比例退款（除适用法律另有强制规定外）。
- 试用期处理：若提供免费试用，开通付费订阅时，试用期中尚未使用的部分（如有）将被作废。
- 付款方：所有付款均由 Apple 处理，并受 Apple 媒体服务条款约束。我们不接触你的支付信息。
价格可能因地区而异，并可能调整；任何价格变动将依 Apple 规则在生效前通知你。
三、积分（生成额度）说明
本应用以「积分」计量诗歌生成额度：
- Pro（订阅）用户：每个订阅周期获得 1500 积分，并在每次续期时重置。
- 免费用户：每月获得 30 积分，并可使用受限的模型选项（轻量级模型）。
- 加权消耗：每次生成所消耗的积分数依你所选的 AI 模型而定——更强或更新的模型每首消耗更多积分，更轻量的模型消耗更少。具体权重可能随模型更新而调整。
- 额度包：你可另行购买一次性消耗型额度包（如 750 积分），用于在当前额度用尽时补充。额度包为一次性购买，非订阅。
- 积分仅可在本应用内用于生成诗歌，不具现金价值，不可转让、不可兑现、不可退款（除适用法律另有强制规定外）。未用完的订阅积分在重置时不结转，除非我们另行说明。
四、AI 生成内容免责声明
本应用的诗歌由第三方人工智能（AI）模型生成。你理解并同意：
- 诗歌内容为 AI 自动生成，可能不准确、不恰当，或不符合你的预期；其呈现的观点不代表我们的立场。
- 生成内容不构成任何专业、法律、医疗、财务或其他建议，不应作为决策依据。
- 由于 AI 的特性，不同用户对相似输入可能得到不同结果，我们不保证任何特定的输出质量、风格或可用性。
- 你应自行判断生成内容是否适合你的用途；对于因依赖生成内容而产生的任何后果，我们不承担责任。
- 你不得使用本应用生成或传播违法、侵权、仇恨、暴力、色情或以其他方式违反 Apple 准则或适用法律的内容。
五、知识产权
- 本应用：本应用及其原创内容、视觉设计、手绘元素、字体编排与软件代码，均归我们或我们的许可方所有，受知识产权法保护。除本协议明确授予外，我们保留一切权利。
- 你生成的诗歌：在适用法律与上游 AI 模型提供商条款允许的范围内，对于你使用本应用就你自己的照片所生成的诗歌文本，我们不主张其所有权；你可将其用于个人用途。请注意，AI 生成内容的版权地位在各司法辖区尚不确定，我们不就你对生成内容享有的任何专有权利作出保证。
- 你的照片：你保留对你照片的全部权利。你声明你拥有上传照片的合法权利。
六、可接受使用
你同意不会：(a) 对本应用进行逆向工程、反编译或反汇编（除适用法律明确允许外）；(b) 滥用、干扰或试图未经授权访问本应用或我们的服务器；(c) 利用本应用从事任何违法活动或侵犯他人权利；(d) 规避积分额度或订阅机制。我们保留对违反本协议的行为暂停或终止你访问权限的权利。
七、保证免责
在适用法律允许的最大范围内，本应用按「现状」及「现有」基础提供，不附带任何明示或默示的保证，包括但不限于适销性、特定用途适用性、不侵权，以及服务不中断或无错误的保证。我们不保证本应用始终可用，或第三方 AI 服务持续可用。
八、责任限制
在适用法律允许的最大范围内，无论基于何种责任理论，我们均不对任何间接、附带、特殊、后果性或惩罚性损害，或任何利润、数据或商誉的损失承担责任。在任何情况下，我们就本协议或本应用产生的全部累计责任，不超过你在引起索赔之事件发生前 12 个月内就本应用实际支付给我们的金额（如有）。部分司法辖区不允许排除或限制某些损害赔偿，故上述限制可能对你不完全适用。
九、第三方服务
本应用依赖第三方服务（Cloudflare、OpenRouter、OpenAI、Anthropic、Google、Apple）运行。你对本应用的使用亦可能受这些第三方各自条款的约束。我们不对第三方服务的行为、可用性或政策负责。数据处理详情见我们的《隐私政策》。
十、终止
如你违反本协议，我们可随时暂停或终止你对本应用的使用权。你可随时停止使用本应用并将其卸载。终止后，第三至八条及第十一条在性质上应继续有效的条款将继续有效。
十一、适用法律与争议解决
本协议受中华人民共和国法律管辖并据其解释（为避免歧义，就本协议而言不包括香港特别行政区、澳门特别行政区及台湾地区的法律），并不考虑其法律冲突规则。因本协议引起的争议，应首先通过友好协商解决。本条款不影响你作为消费者依你居住地强制性法律所享有的权利。就你通过 Apple App Store 进行的购买，Apple 的退款与争议处理政策同样适用。
十二、关于 Apple 的特别条款
你确认本协议仅在你与我们之间订立，与 Apple 无关；Apple 不对本应用或其内容负责。Apple 及其子公司是本协议的第三方受益人，有权（且被视为已接受该权利）针对你执行本协议。任何关于本应用不符合适用保证的索赔，可向 Apple 提出，Apple 将（如适用）退还购买价款；在适用法律允许的最大范围内，Apple 就本应用不承担任何其他保证义务。
十三、本协议的变更
我们可能不时修订本协议。重大变更将通过更新本页顶部的「生效日期」告知。变更生效后继续使用本应用，即表示你接受修订后的协议。

Terms of Use (End User License Agreement)
These Terms of Use (the “Terms”) form a legally binding agreement between you and BoZhi Yuan, the developer of the App (“we,” “us,” or “our”), governing your use of Poetic Mist (the “App”). By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.
1. License Grant
We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited license to download and use the App on an Apple-branded device that you own or control, as permitted by Apple’s terms of service, solely for your personal, non-commercial purposes. The App is licensed, not sold, to you, and you acquire no ownership interest in it.
2. Subscriptions and Billing
The App offers auto-renewable subscriptions through Apple App Store In-App Purchase (IAP) to unlock its full functionality:
- Monthly subscription: $2.99 USD per month (or the local-currency equivalent at Apple’s exchange rate).
- Annual subscription: $29.99 USD per year (or the local-currency equivalent).
- Free trial: Eligible new subscribers may receive a 3-day free trial. If you do not cancel before the trial ends, it will automatically convert to a paid subscription.
Subscription terms:
- Auto-renewal: Your subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period.
- Renewal charge: The renewal fee is charged to your Apple ID account within 24 hours prior to the end of the current period.
- Manage and cancel: You can manage or cancel your subscription at any time in your device’s Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current paid period; no pro-rated refund is provided for the current period except where required by applicable law.
- Trial forfeiture: Where a free trial is offered, any unused portion of the trial (if any) is forfeited when you purchase a paid subscription.
- Payment processor: All payments are processed by Apple and are subject to the Apple Media Services Terms and Conditions. We do not have access to your payment information.
Prices may vary by region and may change; any price change will be communicated to you before it takes effect in accordance with Apple’s rules.
3. Credits (Generation Allowance)
The App meters poem generation using “credits”:
- Pro (subscriber) users: receive 1,500 credits per subscription period, reset at each renewal.
- Free users: receive 30 credits per month and may use a limited set of model options (lightweight models).
- Weighted consumption: the number of credits each generation consumes depends on the AI model you select — more capable or newer models consume more credits per poem, while lighter models consume fewer. The specific weights may be adjusted as models are updated.
- Credit packs: you may separately purchase a one-time, consumable credit pack (e.g., 750 credits) to top up when your allowance is exhausted. Credit packs are a one-time purchase, not a subscription.
- Credits can be used only within the App to generate poems and have no cash value and are non-transferable, non-redeemable, and non-refundable, except where required by applicable law. Unused subscription credits do not carry over at reset unless we state otherwise.
4. AI-Generated Content Disclaimer
Poems in the App are generated by third-party artificial intelligence (AI) models. You understand and agree that:
- The poem content is generated automatically by AI and may be inaccurate, inappropriate, or not what you expect; any views it expresses do not represent ours.
- Generated content does not constitute professional, legal, medical, financial, or any other advice and should not be relied upon for decision-making.
- Because of the nature of AI, similar inputs may yield different results for different users, and we do not guarantee any particular output quality, style, or fitness for use.
- You are responsible for judging whether generated content is suitable for your purposes, and we are not liable for any consequences arising from your reliance on it.
- You must not use the App to generate or distribute content that is unlawful, infringing, hateful, violent, sexual, or that otherwise violates Apple’s guidelines or applicable law.
5. Intellectual Property
- The App: The App and its original content, visual design, hand-drawn elements, typography, and software code are owned by us or our licensors and are protected by intellectual property laws. We reserve all rights not expressly granted in these Terms.
- Poems you generate: To the extent permitted by applicable law and the terms of the upstream AI model providers, we do not claim ownership of the poem text you generate from your own photos using the App, and you may use it for your personal purposes. Note that the copyright status of AI-generated content is unsettled across jurisdictions, and we make no representation that you hold any exclusive rights in generated content.
- Your photos: You retain all rights to your photos. You represent that you have the lawful right to upload any photo you submit.
6. Acceptable Use
You agree not to: (a) reverse engineer, decompile, or disassemble the App except as expressly permitted by applicable law; (b) abuse, interfere with, or attempt unauthorized access to the App or our servers; (c) use the App for any unlawful activity or to infringe others’ rights; or (d) circumvent the credit allowance or subscription mechanisms. We reserve the right to suspend or terminate your access for any violation of these Terms.
7. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the App is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted or error-free. We do not warrant that the App will always be available or that the third-party AI services will remain available.
8. Limitation of Liability
To the maximum extent permitted by applicable law, and regardless of the theory of liability, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. In no event shall our total aggregate liability arising out of or relating to these Terms or the App exceed the amount you actually paid us for the App, if any, in the 12 months preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation may not fully apply to you.
9. Third-Party Services
The App relies on third-party services (Cloudflare, OpenRouter, OpenAI, Anthropic, Google, and Apple) to operate. Your use of the App may also be subject to those third parties’ respective terms. We are not responsible for the conduct, availability, or policies of third-party services. For details on data handling, see our Privacy Policy.
10. Termination
We may suspend or terminate your right to use the App at any time if you breach these Terms. You may stop using the App and uninstall it at any time. Upon termination, those provisions that by their nature should survive — including Sections 3 through 8 and Section 11 — shall survive.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the People’s Republic of China (for the avoidance of doubt, for the purposes of these Terms this excludes the laws of the Hong Kong SAR, the Macao SAR, and the Taiwan region), without regard to its conflict-of-laws rules. Disputes arising out of these Terms shall first be resolved through good-faith negotiation. Nothing in these Terms affects your rights as a consumer under the mandatory laws of your place of residence. For purchases made through the Apple App Store, Apple’s refund and dispute policies also apply.
12. Special Provisions Regarding Apple
You acknowledge that these Terms are concluded between you and us only, and not with Apple, and that Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you. Any claim that the App fails to conform to an applicable warranty may be directed to Apple, and Apple will refund the purchase price (if applicable); to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
13. Changes to These Terms
We may revise these Terms from time to time. Material changes will be indicated by updating the “Effective Date” at the top of this page. Your continued use of the App after a change takes effect constitutes your acceptance of the revised Terms.
